What it is
Government funding to fix urgent fire safety defects in apartments and duplexes built between 1991 and 2013, where the problem came from a breach of the building regulations that applied at the time. The owners' management company applies to the Housing Agency, not individual owners. It funds interim emergency fire safety defect works and in principle all eligible works needed to reach an acceptable level of fire safety in the building, while the full remedial works wait for the statutory scheme. It is an interim scheme ahead of a larger statutory redress scheme still being set up.
Who can get it
- The building is an apartment or duplex development built between 1991 and 2013
- It has fire safety defects arising from a breach of the building regulations that applied at the time
- The application comes from the Owners' Management Company (OMC), not from individual owners
- It is applied for by the Owners' Management Company, so individual owners work through their OMC and managing agent.
- It funds interim emergency fire safety defect works and in principle all eligible works needed to reach an acceptable level of fire safety in the building, while the full remedial works wait for the statutory scheme.
- It is an interim scheme ahead of the larger statutory redress scheme for apartment and duplex defects, which is still being set up.
- The scheme does not cover defects arising from any of three things. The building was not adequately maintained. Sinking funds were not adequately funded to replace building and safety systems when they expired. Later building work was not managed correctly, leading to defects.
